Court Sessions:

The Brook Park Mayor’s Court for the City of Brook Park is in session every other Monday at 4:30p.m., excluding holidays
(see schedule below).

Due to the COVID-19 Pandemic, we are changing the way the court will operate. (Please see ‘COVID-19 New Rules of Court’).

Your case will be subject to a telephone pre-trial discussion with our city prosecutor. This will occur the Wednesday before your court date during the hours of 10 am and 1 pm. Notice will be sent to your home address as noted on your ticket. If your case is resolved, no appearance will be necessary the following Monday.*

*Note: this is why our police officers ask for your telephone number and place the information on your ticket.

If you were issued a citation, your scheduled appearance date and time appears in the lower right corner of the citation. Your appearance in court is mandatory if the officer has indicated personal appearance is required. If the citation is marked as waiverable, you may avoid appearance in court by signing the waiver form and paying the fine and costs no later than 3:00pm the day of your scheduled court date. No. The court is presided over by the Magistrate who decides the cases.

The court date is noted on the bottom right hand corner of the citation. If you are pleading “no contest” or “not guilty” or have not paid your waiver amount by the day before your court date, you MUST appear on that date. For any other questions regarding a court date, please contact the Clerk of Courts office M-F 9am-4pm.

Everyone is entitled to one continuance. The deadline for a continuance is 4:00 p.m. the day before your original court date. A continuance fee of $5.00 will be added to your case. Once you receive a continuance, your court appearance is now MANDATORY.

We accept cash, money orders, Master Card, Visa, Discover and debit cards with the MC/Visa logo. We do NOT accept checks or American Express.

You can pay your waiverable ticket up to 4:00 p.m. on the day before your original court date in person at the clerks office, on-line at www/ohioticketpayments.com/brookpark or mail signed ticket (signature required on the back of your ticket) along with your money order made payable to the “City of Brook Park” at least 10 days prior to your court date.

Your case will be transferred to Berea Municipal Court. If your case is transferred, we no longer have any information on the case; therefore, you must call them with any questions.

What You Should Know About Traffic Citations

You are required by law to provide proof of insurance. If you did not provide this information to the officer, you are required to provide it at your Court appearance or to the Clerk of Courts office when paying your ticket in person or enclosing a copy of your insurance card when paying by mail. You may also fax a copy or have your insurance company fax a copy to 216-433-4183. The date your citation was issued must be covered on the card you submit. Failure to provide proof that you are insured on the date you were issued the citation will result in your operator’s license being suspended for a minimum of ninety (90) days through the Bureau of Motor Vehicles.

The amount you owe (if waiverable) is due no later than 4:00 pm on the day before the Court date noted at the bottom of your ticket. If paying by mail, please sign the back of the ticket and enclose it with your payment. Money orders are to be made payable to the City of Brook Park. (Please note: We no longer accept checks.) If you fail to pay your fine before your Court date, you must appear in court. Your fine is only waiverable if paid by 4pm the day before your original court date. If you fail to appear in Court as scheduled, a warrant for your arrest will be issued and your license will be canceled through the BMV.

These include but are not limited to any indictable offense:

  • Operating a motor vehicle while under the influence of alcohol or drugs.
  • Any offense resulting in an accident.
  • Leaving the scene of an accident.
  • Reckless driving.
  • Exceeding the speed limit by 20 mph or more in a School Zone.
  • Driving under suspension or revocation of a driver’s or commercial driver’s license.
  • Driving without a license to drive, except where the driver’s or commercial driver’s license has been expired less than 6 months.
  • A third moving traffic offense within twelve months.
  • Failure to stop for a school bus.
  • Willfully eluding or fleeing a Police Officer.
  • Drag racing.
  • Any Criminal Misdemeanor Offense.
  • Any drug offense.
  • Any Property Maintenance or Building Code violation.

All ‘Not Guilty’ or ‘No Contest’ pleas require a court appearance.
All ‘Not Guilty’ pleas will be transferred to Berea Municipal Court.
